Alternative Dispute Resolution

You Have Options To Settle Your Divorce

Many people view divorce as a painful process fraught with conflict. Although divorce is bound to be emotional for everyone involved, and disagreements are inevitable, you can get through it with less conflict and more control than a court trial. Alternative dispute resolution options give you more say in your outcome and can save you time and money.

At Caesar & Bender, LLP, we do our best to help you resolve your divorce with as little pain and conflict as possible. Parties often find that they agree on more than they think and can work out the areas where they disagree. You know your family’s situation much better than any judge. We can help you come up with an agreement that will fit your family and your goals for the future.

What Are The Alternatives To Court?

Alternative dispute resolution comes in many styles. We can work with you to figure out what will be the best option for your situation. These options include:

  • Mediation – Mediation in divorce allows both parties to sit down with a third person, the mediator, to try to work out their differences and come to an agreement. In many cases, the court will order you to at least attempt mediation, especially if you have children involved. Our attorneys can serve as mediators.
  • Settlement negotiation – Attorneys for both parties can work out an agreement on behalf of their clients and draw up the documents for you to sign.
  • Arbitration – Arbitration is a step between mediation and a court trial. Both parties agree on an arbitrator to hold a hearing and decide on the issues. The judge then reviews the arbitrator’s decision for approval.

These alternatives have the added benefit of privacy from the public. Of course, if you simply cannot come to an agreement, our seasoned trial lawyers are always prepared to go to court and fight for your legal rights. For most people, however, there is a better way to accomplish your goals, and we can help you get there.
